These Terms apply to your use of www.bwdomains.co.bw (the “Website”) and any purchase or use of software, products, or services offered through it (the “Services”). The Website is operated by Mindtech Alliance (Proprietary) Limited, trading as bwdomains. bwdomains is an accredited registrar of .bw domain names under BOCRA.
We may update these Terms from time to time; changes take effect immediately upon posting and apply to continued use of the Website/Services.
1. Access to the Website
Access is provided on a temporary basis and may be suspended, withdrawn, or changed for business, security, or operational reasons. We are not liable for periods of unavailability.
2. Account Eligibility
You are 18 years or older.
If acting for another, you are authorised to bind them to these Terms.
Registration information is accurate, current, and complete; false information may lead to termination.
You are responsible for all activity on your account and for safeguarding credentials.
3. Accounts & Passwords
Keep login credentials confidential. We may disable credentials for non-compliance. If you suspect unauthorised access, notify us at info@bwdomains.co.bw.
4. Account Security & Company Systems
Secure scripts/programs under your account and use strong passwords; weak credentials may be suspended until fixed.
Systems may be monitored for security/operational purposes; by using the Services, you consent to monitoring.
Unauthorised access to third-party systems is prohibited and may result in suspension.
Compromised accounts may be disabled/terminated; cleanup assistance may be available for a fee.
We may migrate your account between data centres for policy, legal, or technical reasons.
5. Compatibility with the Services
You are responsible for ensuring your content/websites are compatible with our infrastructure.
You are responsible for your own backups; we do not warrant backup of user content.
Domain registration does not include DNS hosting unless you purchase hosting/email with us.
6. Billing & Payment Information
Pre-payment: Services are prepaid. Keep payment info up to date.
Auto-renewal: Unless cancelled, services may renew automatically to prevent disruption.
Advance Account: Insufficient balance may block orders; negative balances must be settled within 24 hours.
Taxes: Fees exclude taxes; applicable taxes will be added.
Late/Non-Payment: Overdue invoices may result in suspension or termination and recovery of collection costs.
Dedicated Servers: If unpaid 15 days after expiry, data may be permanently deleted.
Domain Renewals: Renewal notices are a courtesy; no refunds after renewal.
Fraud: Misuse of payment methods may be reported to authorities.
Price Changes: At least 30 days’ notice prior to charging new prices.
7. HIPAA Disclaimer
Our Services are not designed for HIPAA-regulated data or similar sensitive health data. We do not sign Business Associate Agreements.
8. Money-Back Guarantee
Dedicated Servers: Not eligible for the 30-day money-back guarantee.
Cancel within 30 days for a refund on eligible hosting services. No refunds for domain registrations. If a free domain was included, a non-refundable domain fee will be deducted; you retain the domain for the registration term. New domains cannot be transferred within the first 60 days. No refunds after 30 days.
10. Cancellation Process
Cancel via the control panel. Fees accrued before effective cancellation remain payable. Pending orders may process if sufficient funds are available; otherwise charges may be reversed and orders cancelled.
11. Viruses & Cybersecurity
Use up-to-date antivirus and do not misuse the Website (e.g., malware, unauthorised access, DoS). Breaches may be reported under Botswana’s Cybercrime and Computer Related Crimes Act, 2018.
12. Backup Policy
You are solely responsible for backing up any data associated with your hosting packages. We strongly recommend that you take periodic backups and store them in a separate location in the event that you need to restore your data for any reason. You may request a backup of the last 7 days (from the date of request) from us and we will try to restore your data from our disaster recovery backups, subject to your payment of backup service fees. These backup services are provided as a courtesy, not an obligation. We do not maintain any backups for VPS, Dedicated servers, Managed Servers, or Business Email.
13. Termination
We may terminate access without notice for non-payment, violations, harmful conduct, or as otherwise specified. Fees paid in advance are non-refundable; charges accrued remain payable. Upon termination, data may be deleted.
14. CPU, Bandwidth & Disk Usage
Permitted Use: Shared hosting space is for web files, active email, and site content. Prohibited: general data storage, off-site backups, gaming servers, >100,000 files, MySQL queries >15s, >50% disk used by email (and >10GB email total per order), databases >5GB unless plan allows.
Resource Limits: If usage exceeds fair use (e.g., >25% system resources >90s) affecting stability, we may require an upgrade, restrict resources, or take remedial action.
